Indian doctor Mohamed Haneef has won his Federal Court bid to get his Australian work visa back.

Sitting in Brisbane, the court ruled that Immigration Minister Kevin Andrews made a jurisdictional error when he cancelled Dr Haneef's visa on character grounds.

Justice Jeffrey Spender prefaced his finding by saying although there was a political aspect to the case, his job was to do his best according to the law.

The Crown has successfully applied for a 21-day stay of the decision.

Dr Haneef's visa was cancelled just hours after he was granted bail on a charge of providing support to a terrorist organisation.

Dr Haneef returned to India late last month after the charge was dropped and he was released from a Brisbane jail.

The former registrar at the Gold Coast Hospital has expressed a desire to return to Australia.

Speaking before today's decision was handed down, Mr Andrews said he was likely to appeal against the court's ruling.

"I don't think today will be the end of the matter, I think whatever the result in the court today that'll probably end up on appeal and who knows even in the High Court one day."
